Your privacy is important to us. To better protect your privacy we provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used. This online privacy statement (“Privacy Statement”) applies to the TalentQuest Web Site located at www.talentquest2.com (collectively, the “Site”). By using or accessing the Site, you represent and warrant that you have the right, authority and capacity to accept the terms of this Privacy Statement and you are accepting the practices described in this Privacy Statement.
Information Collection & Use
In order to use this Site, you must first create a user name and password. Your employer (or potential employer) (collectively, “Employer”) has provided us with your contact information (such as name and email address). We may use this information to contact you about the services on our Site. Generally, you may opt out of such emails as set forth in this Privacy Statement, provided TalentQuest reserves the right to send you certain transactional or relationship notices about your account even if you opt out of all voluntary email notifications.
TalentQuest is not the sole owner of the information collected on TalentQuest. Any information submitted on this Site may be shared with your Employer in connection with its use of the TalentQuest Services and/or Site. TalentQuest collects personally identifiable information from our users at several different points on this Site.
Uses of Information
TalentQuest uses the information you submit on the Site to provide you and your Employer with Talent and Performance Management related services (e.g., performance appraisals, 360 feedback, selection assessments, succession planning, competency modeling, and/or compensation management).
We collect and store any information you enter on the Site or provide to us in any other way. We use the information that you provide for such purposes as responding to your requests, providing our services, and communicating with you and your Employer. Users should be aware that any user generated content or information submitted by you on the Site (such as ratings or comments) will be made available to others, and may personally identify the user as the source of these ratings and/or comments (unless otherwise stated). This Privacy Statement does not apply to any such user generated content and we are not responsible for circumvention of any privacy settings or security measures contained on the Site with respect thereto. You understand and acknowledge that, even after removal, copies of such user content may remain viewable in cached and archived pages or if other users have copied or stored your user content.
TalentQuest may collect information about the use of the Site, such as the types of services used and how many users we receive daily. This information is collected in aggregate form, without identifying any user individually. TalentQuest may use this aggregate, non-identifying statistical data for statistical analysis, research, marketing, or similar promotional purposes. In addition, TalentQuest analyzes aggregate data as part of ongoing efforts to validate and enhance our product.
Communications from the Site
We will send you strictly service-related announcements on occasions when it is necessary to do so. For instance, if you are a participant in a performance appraisal or a 360 feedback survey, we will send you a notification email. In some instances, we may also send you other notification/reminder emails related to the performance management process.
Generally, you may not opt-out of these communications, which are not promotional in nature. You may opt out of the 360 feedback process and the emails related to that 360 feedback process by following the opt-out procedure specified in such e-mail. If you do not wish to receive any emails, your Employer has the option to deactivate your account.
We will communicate with you in response to your inquiries, to provide the services you request, and to manage your account. We will communicate with you by email or telephone, in accordance with your reasonable instructions.
Information Sharing and Disclosure
Aggregate Information (non-personally identifiable)
We may disclose aggregate data for validity, reliability, and normative research, though in such analyses data will not be identified by individual.
Personally identifiable information:
We reserve the right to disclose your personally identifiable information (i) if we are required to do so by law or legal process, (ii) to law enforcement authorities or other government officials based on an enforceable government request or as may be required under applicable law, or (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity.
Participation in the services offered on our Site (e.g., performance appraisals, 360 feedback, selection assessments, succession planning, and/or compensation management) is voluntary and based on your relationship with your Employer.
As is true of most web sites, we gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.
We use this information to analyze trends, to administer the Site, to provide support, to track users’ movements around the Site and to gather demographic information about our user base as a whole.
We do not link this automatically-collected data to personally identifiable information.
When visiting our Site we maintain data on the user’s activities on our servers within a session. This session is uniquely identifiable via a temporary session token. We store this session token in the session cookie.
We use both session ID cookies and/or persistent cookies. We use session cookies to make it easier for you to navigate our Site. A session ID cookie expires when you close your browser, and does not contain any personally identifiable information. A persistent cookie remains on your hard drive for an extended period of time. We set a persistent cookie to store your login id, so you don’t have to enter it more than once.
If you reject cookies, you may still use our Site, but your ability to use some areas of our Site may be limited.
Some Internet browsers have begun to offer what often is referred to as “do not track” mechanisms for browser users to automatically signal privacy preferences to websites that they visit. Internet browsers have only begun to include these features relatively recently and there is not yet a consensus about what steps a website should take when it receives a do-not-track signal from a site visitor’s browser or what information collection or use restrictions should be applied when a do-not-track signal is received. As a result, our site does not currently respond to do-not-track-signals. We are continuing to monitor do not track developments and may revisit the issue in the future.
We do not authorize third parties, such as advertising networks, to collect personally identifiable information about an individual’s online activities over time and across different websites when the individual uses our service.
Access to Personally Identifiable Information
If your personally identifiable information changes, you may update it by making the change on your personal profile page or by emailing your company administrator. You may access your profile page by clicking the profile link on the TalentQuest Home Page (www.talentquest2.com).
Access to Talent and Performance Management related data stored by TalentQuest (such as assessments or 360 feedback reports) is provided at the discretion of your Employer.

We follow generally accepted industry standards to protect the personally identifiable information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

Safe Harbor Privacy Principles
TalentQuest’s practices regarding the collection, storage, transfer, use and other processing of Personal Information comply with the Safe Harbor principles of notice, choice, onward transfer, access, security, data integrity, and enforcement and oversight.
We notify our consumers and customers located in the EEA about the purposes for which we collect and use Personal Information, the types of third parties to which we disclose the information, the choices consumers and customers have for limiting the use and disclosure of their information, and how to contact us about our practices concerning Personal Information.
Purpose of Collection and Use of Personal Information
TalentQuest collects certain Personal Information such as name, email address, postal address and telephone number. We may collect sensitive Personal Information, as defined by the Safe Harbor framework, such as information about ethnicity, but provision of this information is voluntary. TalentQuest provides individuals affirmative choice before the information is disclosed to a third party or used for a purpose other than those for which it was originally collected or subsequently authorized by the individual through the exercise of opt in choice.
We use Personal Information (i) to provide you and your employer with Talent and Performance Management related services (e.g., performance appraisals, 360 feedback, selection assessments, succession planning, competency modeling, and/or compensation management), (ii) to respond to your requests, (iii) to evaluate the quality of our services, (iv) to communicate with you about our services and related issues, and (v) for internal administrative and analytics purposes and to comply with our legal obligations, policies and procedures.
We do not use Personal Information for purposes incompatible with the purposes for which the information was originally collected without notifying the relevant consumers or customers of such uses and offering an opportunity to opt out (or, in the case of sensitive personal information, opt-in).
Onward Transfer of Personal Information
We do not share Personal Information with any non-agent third parties; provided, however, we will share your Personal Information with your Employer pursuant to, and in connection with, the services performed on your behalf and as procured by your employer. TalentQuest will obtain assurances from its agents that they will safeguard Personal Information consistently with this policy. Examples of appropriate assurances that may be provided by agents include: a contract obligating the agent to provide at least the same level of protection as is required by the relevant Safe Harbor Principles, being subject to EU Directive 95/46/EC (the EU Data Protection Directive), Safe Harbor certification by the agent, or being subject to another European Commission adequacy finding (e.g., companies located in Switzerland). Where TalentQuest has knowledge that an agent is using or disclosing Personal information in a manner contrary to this Policy, TalentQuest will take reasonable steps to prevent or stop the use or disclosure.
In addition, we may disclose Personal Information (i) if we are required to do so by law or legal process, (ii) to law enforcement authorities or other government officials based on an enforceable government request or as may be required under applicable law, or (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity.
Access to Personal Information
TalentQuest provides consumers and customers with reasonable access to the Personal Information maintained about them. We also provide a reasonable opportunity to correct, amend or delete that information where it is inaccurate. We may limit or deny access to Personal Information where providing such access is unreasonably burdensome or expensive under the circumstances, or as otherwise permitted by the Safe Harbor principles. TalentQuest maintains reasonable administrative, technical and physical safeguards to protect Personal Information from loss, misuse and unauthorized access, disclosure, alteration and destruction.
TalentQuest takes reasonable steps to ensure that Personal Information that we collect is relevant for the purposes for which it is to be used and that the information is reliable for its intended use and is accurate, complete and current. We depend on our consumers and customers to update or correct their Personal Information whenever necessary.
Enforcement and Oversight
TalentQuest has established procedures for periodically verifying implementation of and compliance with the Safe Harbor principles. We conduct self-assessments of our practices with respect to Personal Information to verify that representations we make about our Personal Information privacy practices are true and that related privacy policies have been implemented as represented.
TalentQuest has further committed to refer unresolved privacy complaints under the US-EU Safe Harbor Principles to an independent dispute resolution mechanism, the BBB EU SAFE HARBOR, operated by the Council of Better Business Bureaus.
